Por solicitud de la Fiscalía General de la Nación, un juez de control de garantías impuso medida de aseguramiento privativa de la libertad en centro carcelario a Gabriel González Cubillos, como presunto responsable de la muerte de su hijo de cinco años, en hechos ocurridos el pasado 3 de octubre en un hotel, en Melgar (Tolima). El procesado, de manera libre y voluntaria, aceptó el cargo imputado.
Desde el momento en el que fue encontrado el cuerpo del menor de edad, la Fiscalía dispuso de un equipo especializado conformado por la Brigada de Homicidios del CTI, expertos en lofoscopia, fotografía, topografía e informática forense del Grupo de Criminalística de Ibagué, entre otras especialidades.
En atención a la abundante evidencia técnica y científica recopilada, un fiscal de la Seccional Tolima imputó al señalado agresor el delito de homicidio agravado.
Los hechos
La mañana del sábado 1 de octubre, Gabriel González Cubillos recogió a su hijo en el lugar de residencia de su excompañera sentimental, en el barrio Sierra Morena, en la localidad de Usme, en el sur de Bogotá. Esto, en atención al permiso que tenía para visitar y llevarse a su hijo cada 15 días.
Durante la tarde del domingo 2 de octubre, la madre llamó a su expareja para preguntarle por la hora en la que regresaría al niño a la casa; sin embargo, el hombre no contestó y respondió con un mensaje por WhatsApp en el que le pedía a la mujer ubicar una memoria USB que había dejado en el baño del inmueble. El dispositivo contenía videos en los que González Cubillos se mostraba amenazante y con la intención de hacerle daño al menor de edad.
En la noche, padre e hijo llegaron a un hotel en Melgar (Tolima) y se hospedaron en una habitación en el segundo nivel. En la madrugada del lunes, el hoy procesado volvió a escribir al celular de su excompañera sentimental. Indicó que le había quitado la vida al niño y compartió una fotografía que así lo confirmaba. Con la luz del día, pasadas las 7 a.m., el señalado homicida salió del establecimiento de comercio.
Judicialización por cohecho
Gabriel Enrique González Cubillos fue interceptado por unidades de la Dirección de Tránsito y Transporte de la Policía Nacional en inmediaciones de Nilo (Cundinamarca), en la vía que conduce de Girardot (Cundinamarca) a Bogotá. Al parecer, trató de huir por una zona boscosa al ver a los uniformados, pero fue alcanzado. Sin posibilidades de escapar habría ofrecido $50.000 a los policías para que lo dejaran marchar, por lo que fue capturado.
Por esta actuación, la Fiscalía presentó a este hombre ante un juez de control de garantías y le imputó el delito de cohecho por dar y ofrecer. El cargo fue aceptado.
