Mediante falsedades e inconsistencias en la disposición del uso del suelo se permitió la construcción de varias bodegas.
La Fiscalía General de la Nación obtuvo condena contra la exdirectora de la Oficina de Planeación de Funza (Cundinamarca), Adriana Milena Orozco Quecano; y el particular Mario Angulo, por múltiples irregularidades que permitieron la construcción de un denominado Parque Industrial en la Sabana Occidente de Bogotá.
Un fiscal de la Dirección Especializada contra la Corrupción demostró que la exfuncionaria, valiéndose del cargo que ocupó entre 2012 y 2014, expidió una licencia de construcción parcelar en 34 lotes un predio de 168.000 metros cuadrados. Con esta disposición se desconoció la normatividad vigente que prohíbe usar más del 50% de un terreno en zona suburbana. Aquí se demostró que se autorizó el aprovechamiento del 63% del área.
Posteriormente, la entonces directora de la Oficina de Planeación de Funza recurrió a falsedades para modificar la licencia y permitir que la parcelación aumentara a 41 lotes sobre un predio de 176.000 metros cuadrados, en beneficio de Mario Angulo.
Con estas actuaciones se hizo incurrir en error a servidores de una notaría de Tabio (Cundinamarca) y de la Oficina de Instrumentos Públicos Zona Centro de Bogotá, que protocolizaron los trámites de escrituración. De esta manera se construyeron bodegas y el Parque Industrial en inmediaciones de Funza.
Por estos hechos, la señora Orozco Quecano fue sentenciada a siete años y un mes de prisión por los delitos de prevaricato por acción y falsedad ideológica en documento público. Adicionalmente, deberá pagar una multa de 37 millones de pesos y cumplir una inhabilidad pare ejercer funciones públicas por 102 meses. El fallo ordenó la captura inmediata de la exfuncionaria para hacer efectiva la pena en centro carcelario.
De otra parte, un particular fue declarado responsable del delito de fraude procesal, y condenado a seis años y tres meses de prisión. El juez dispuso una multa cercana a 113 millones de pesos y le reconoció el beneficio de detención domiciliaria.
